Study course description
Preliminary Knowledge:
Basic knowledge of constitutional law and the legal framework of the Operational Activities Law.
Objective:
To learn the requirements of international and national law on ensuring the protection of personal privacy. To learn about the regulatory requirements for carrying out operational activities with as little interference in private life as possible. To understand the impact of different operational activities measures on the violation of a person’s privacy. To know how to apply the regulatory requirements and observe proportionality in decision-making and processing, including when applying to a judge or prosecutor, obtaining approval, implementing an operational activities measure.

Assessment
Unaided Work:
Independently studies the assigned case law of the Court of Justice of the European Union, Supreme Court, internal regulatory enactments and doctrine on the issues at hand. Prepares two draft decisions (for the prosecutor’s office and the court) on the implementation of an operational activities measure to be performed in accordance with the special method. In order to evaluate the quality of the study course as a whole, the student must fill out the study course evaluation questionnaire on the Student Portal.
Assessment Criteria:
Students must obtain a pass mark in the practical assignments for the practical work done, which accounts for 50% of the final assessment. Students must pass the theoretical part of the exam (50% of the final assessment). The assessment of the exam results is carried out in accordance with the RSU Academic Regulations I “System of Assessment of Learning Outcomes”.

Learning Outcomes
Knowledge:Upon successful completion of the study course, the student: - is able to assess the human rights requirements of international and national law in the preparation of decisions on the implementation of operational activities measures to be performed in accordance with the special method; - justifies the appropriateness of the chosen operational activities measures to the threat and to human rights.
Skills:Upon successful completion of the study course, the student: - prepares decisions on the implementation of operational activities measures to be performed in accordance with the special method, based on EU and national case law; - prepares decisions in accordance with the conditions, requirements and practice for turning to the courts and prosecutors’ offices for an operational activities measure.
Competencies:Upon successful completion of the study course, the student is able to organise and implement operational activities measures in such a way as to prevent unjustified interference and to minimise intrusion into a person’s private life.
